Terms & conditions
Written in plain English on purpose. These terms apply when you book a ceremony or florals with me, and nothing in them takes away the rights the Australian Consumer Law gives you.
In these terms, “I”, “me” and “my” mean Felicity & Forever (ABN 56 121 571 469), and “you” means the couple booking a ceremony, florals, or both. A booking is confirmed when I’ve received your booking fee and sent you a written confirmation of your date and package.
Services and fees
My ceremony packages and their inclusions are set out on the Weddings & Florals page and confirmed in writing when you book. The price in your booking confirmation is the price, and it doesn’t change after you’ve booked. Florals are designed to your brief and quoted separately. Travel beyond 100 km of Echuca / Moama is additional, always discussed and agreed upfront, never a surprise on an invoice.
Booking and payment
A booking fee, stated in your booking confirmation, secures your date. It means I turn other couples away for that day, which is why it isn’t refundable if you simply change your mind. The remaining balance is due four weeks before your ceremony unless your booking confirmation says otherwise. If the balance isn’t paid by then, I’ll remind you before anything else happens; if it remains unpaid close to the date, I may treat the booking as cancelled by you.
If you cancel
Cancellations must be in writing (email is fine). What you pay depends on how much notice you give, because it reflects the work already done and the likelihood of re-booking your date:
- More than 8 weeks before your date: the booking fee only.
- 8 weeks to 14 days before: the booking fee, plus a fair amount for work already completed and costs already committed (for florals, that includes flowers already ordered).
- Less than 14 days before: up to the full fee, less anything I save by not performing the services.
If I re-book your date, I’ll refund what the re-booking covers. I don’t keep money the cancellation didn’t actually cost me. And if I am the one who cannot deliver and no substitute is arranged, you receive a full refund of everything paid for the affected services, including the booking fee.
If you postpone
Life happens. If you need to move your date, your booking fee and any payments transfer once, free of charge, to a new date within 12 months, subject to my availability. If we genuinely can’t find a date that works, the cancellation terms above apply from the date you first asked to postpone, not from the new date.
If something outside everyone’s control (a public health order, a natural disaster, serious illness) makes the ceremony impossible for either of us, we reschedule first at no extra cost. If rescheduling truly isn’t possible, I refund everything except a fair amount for work already done.
If I can’t be there
If illness or emergency means I cannot attend your ceremony, I’ll make every reasonable effort to arrange another authorised celebrant you approve, brief them fully, and pass on your documents securely (they must sight your original documents before the ceremony; that’s the law, not fuss). If no substitute can be found, everything you’ve paid for the ceremony is refunded in full.
The legal side of getting married
Some dates are set by the Marriage Act 1961, not by either of us:
- Your Notice of Intended Marriage must reach me at least one month, and at most 18 months, before your ceremony.
- I must sight your evidence of identity, and evidence of how any previous marriage ended, before I can marry you.
- A ceremony inside the one-month notice period is only possible if a prescribed authority approves a shortening in limited circumstances. I can guide you through that, but I cannot promise it.
- After the ceremony I lodge your papers with the Registry of Births, Deaths and Marriages of the state where you married, within 14 days.
Every booking is subject to these requirements, and you agree to give me accurate information and documents in time to meet them.
Florals
Flowers are living, seasonal things. I’ll always design to the brief we agree, but if a specific bloom isn’t available or isn’t at its best close to your date, I may substitute flowers of equal value and style so your day still looks the way we imagined it. You’re responsible for making sure I can access the venue at the agreed times for delivery and set-up. Because florals are made to order, cancellation costs include flowers already committed to growers.
Your day, your photos
I never publish photos from your ceremony, or use your names or words in testimonials, without your express permission, asked properly for each use, never assumed, never buried in these terms. Saying no will not affect your ceremony in any way. My privacy policy explains how I look after your personal information more broadly.
What I ask of you
- Accurate details, and documents supplied in good time.
- Any permits or permissions your venue or location requires (I can point you in the right direction).
- Being ready near the agreed time. If a ceremony runs very late I may need to leave for legal or booking reasons, though I’ll always tell you before it becomes a problem.
If something goes wrong
As a consumer, you have guarantees under the Australian Consumer Law (services provided with due care and skill, fit for purpose, within a reasonable time), and nothing in these terms excludes, restricts or modifies them. If you’re unhappy with anything, tell me first at [email protected] and I’ll do my best to put it right. Concerns about my conduct as a celebrant can also be raised with the Commonwealth Attorney-General’s Department, which regulates marriage celebrants; details are at ag.gov.au. And as your celebrant I’m also here to point you to relationship support services at any stage. Just ask.
This website
Everything on this site is general information, offered with love but without any promise it suits your specific circumstances; package details and pricing are indicative until confirmed in your written quote. The words and images here belong to Felicity & Forever. Please ask before reusing them. Links to other sites are offered helpfully, not as endorsements.
Governing law and changes
These terms are governed by the law of Victoria, Australia, though I happily marry couples on both sides of the Murray, and the Marriage Act applies Australia-wide. If these terms change, the new version applies to new bookings only; your booking keeps the terms you agreed to.
Questions before you book? Nothing here is meant to be scary. Email [email protected] or say hello and ask me anything.
